Official Rules (stuff the lawyers made us say)
1. NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR TO WIN. A PURCHASE OR PAYMENT WILL NOT IMPROVE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
2. Am I Eligible To Participate? Subject to the additional restrictions below, the PlayerAuctions Screenshot & Caption Contest (the “Contest”) is open to contestants who are eighteen years of age or older at the time of entry. Employees of PlayerAuctions LLC (the “Sponsor”) and its affiliated companies, and advertising and promotional agencies, and the immediate family members of, and any persons domiciled with, any such employees, are not eligible to enter or to win. The term “immediate family members” includes spouses, parents, grandparents, siblings, children, and grandchildren.
3. How Do I Enter?
Weekly Caption Contest. The Weekly Caption Contest will begin each week upon the publishing of the previous weeks Weekly Screenshot Contest Winner. To enter, simply submit a funny caption with your email address or PlayerAuctions username using the form provided above. Multiple entries per person per week are accepted.
Weekly Screenshot Contest. The Weekly Screenshot Contest will begin on May 23, 2008. To enter, simply submit a screenshot that you think will inspire funny captions from any of the games supported by the PlayerAuctions website to contest@playerauctions.com. Multiple entries per person per week are accepted.
General Entrance Rules.
No mail-in entries will be accepted. Sponsor will not be responsible for incomplete, lost, late, misdirected or unreadable entries or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Sponsor.
In the event of a dispute, all entries will be deemed to have been submitted by the owner of the email account from which they were sent. For these purposes, an email account holder shall mean the natural person assigned to such email account by the Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with such email account.
Any questions regarding the number of entries submitted or the owner of an email account shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Contest. Sponsor reserves the right to disqualify any entry that does not comply with these rules. By submitting a caption and/or screenshot, you agree to be bound by all of the terms and conditions of these Official Rules; if you do not agree with these terms and conditions, do not submit a caption and/or screenshot.
All entries become property of Sponsor and none will be returned. By submitting a caption and/or screenshot in the Contest, you acknowledge and agree that Sponsor shall have the right (without limitation or further compensation to you) to edit, adapt, modify, reproduce, publish, promote, display and otherwise use your entry in any way it sees fit, including the right to publish your entry as described herein.
4. How Will Winners Be Selected?
Weekly Caption Contest Winners. Each Friday from May 30, 2008 through the duration of the Contest, Sponsor will select one (1) weekly caption winner (“Weekly Caption Winner”). Weekly Caption Winners will be selected by Sponsor on the basis of humor and creativity from any of the eligible captions submitted for a given screenshot. In the event two or more eligible entries contain the identical caption (including punctuation) and are selected as a winner, the Sponsor will draw the winner by random selection. Sponsor may also post on the PlayerAuctions website captions that are selected as “honorable mentions” rather than as winners. Judging and evaluation of captions will be conducted by the Sponsor, whose decisions shall be final and binding in all respects.
Weekly Screenshot Contest Winners. Each Friday from May 30, 2008 through the duration of the Contest, Sponsor will randomly select one (1) weekly screenshot winner (“Weekly Screenshot Winner”). Weekly Screenshot Winners will be selected from any of the eligible screenshots submitted since the beginning of the Weekly Screenshot Contest on May 30, 2008 until Friday at midnight of the previous week, i.e. the September 26, 2008 Weekly Screenshot Winner could be selected from all screenshots submitted from the beginning of the contest on May 23, 2008 to midnight September 26, 2008. Weekly Caption Winners will be selected by Sponsor on the basis of inspiring humorous captions and photo quality. Judging and evaluation of screenshots will be conducted by Sponsor and the Contest judges appointed by Sponsor, whose decisions shall be final and binding in all respects.
All Winners. Except where prohibited: (i) acceptance of a Prize constitutes consent to use winner’s name, likeness, and winning entry for editorial, advertising, and publicity purposes, without further compensation; (ii) winner may be required to sign an affidavit of eligibility and copyright transfer/liability/publicity/permission release. Affidavits and releases must be returned within thirty (30) days of attempted notification or an alternate winner may be chosen.
5. What Could I Win? Once selected, each Weekly Caption Winner and Weekly Screenshot Winner may select to receive their choice of a $20 Amazon Gift Certificate or $50 in cash equivalent for use on the PlayerAuctions website.
6. When Will Winners Be Notified? Each Weekly Winner will be notified by email (at the email address from which his or her entry was submitted) within seventy-two (72) hours after he or she is selected as a Weekly Caption Winner and/or a Weekly Screenshot Winner. Sponsor’s inability to reach a winner, the return of any prize notification as undeliverable, a winner’s failure to timely respond to prize notification, and/or a winner’s failure to comply with any term or condition of these Official Rules may result in that winner’s disqualification, the forfeiture of his or her interest in all prizes, and the selection of a substitute winner. Winners may be required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law) which must be returned within ten (10) days of date of personal delivery or date of sender’s postmark.
7. What Other Terms Apply? Winners may waive their right to receive a prize. Prizes are non-assignable and non-transferable. No substitutions or cash equivalents allowed by winners. Winners are solely responsible for reporting and payment of any taxes on prizes. Except where prohibited, participation in the Contest constitutes each contestant’s consent to the publication of his or her name, likeness, city and state of residence and biographical information in any media, including without limitation the Internet, for any commercial or promotional purpose, without limitation or further compensation. Prizes not won and claimed by an eligible winner in accordance with these Official Rules will not be awarded and will remain the property of Sponsor. By participating, entrants agree to be bound by these Official Rules and the decisions of Sponsor and Contest judges designated by Sponsor. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Contest as solely determined by Sponsor. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. PlayerAuctions reserves the right to end the contest at the date of their choosing. Entrants release PlayerAuctions and its respective parent divisions, affiliates, officers, subsidiaries, agents, employees and all others associated with the development and execution of this giveaway from and against any liability with respect to or in any way arising from this contest and the awarding and use of the prizes.
8. Who Is The Sponsor? The PlayerAuctions Screenshot & Caption Contest is sponsored by PlayerAuctions, LLC. The decisions of Sponsor regarding the selection of winners and all other aspects of the Contest shall be final and binding in all respects. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the Contest.
9. How Can I Request The Winners’ Names Or A Copy Of These Rules? For the names of the winners (available after May 31, 2008) or a copy of these Official Rules send a self-addressed, stamped envelope (VT residents may omit return postage) to PlayerAuctions LLC., 1850 Sawtelle Blvd., Suite 410 W. Los Angeles, CA 90025. Indicate whether you are requesting the winners’ names, a copy of these official rules, or both.
